Parental Rights in The United States

It will never cease to amaze me, the things that the legal system lets people get away with, again and again, just because the authorities are to busy too properly investigate a case, refuse to listen to BOTH  parties, and make their decisions according to the facts of the case instead of always assuming someone is telling the truth when facts might paint a completely different story.  The ridiculous claim that God had anything to do with the "freedom" in the circumstance my family is dealing with at this point time is just insane. My question remains, "who is looking out for the welfare of the children?"

Laws About Parental Abduction

It is against the law in virtually every state of the union for a non custodial parent or the parent who does not have residential custody to keep the children from the custodial parent. If a custodial parent fears that his or her ex may try to take their children, they can petition the court for an abduction prevention order. Abduction prevention orders can restrict a parent from traveling with a child ie they can require them to give a copy of their itinerary and travel documents to the custodial parent, require them to get permission from the court before traveling with the child, or require them to surrender the child's passport to the court. In some cases, the court limits visitation or requires it to be supervised. The court issues these orders based on its belief that a kidnapping threat is credible. The length of time an abduction order lasts is up to the judge. These laws also apply to taking a child out of state without notifying the court where custody was decided that you intend to leave the state to take up residence in another state. If you are in doubt as to whether a law has been broken and you don't know where your kids are, or you have been illegally denied access to them, consult your local law enforcement agency or engage the services of an attorney. I know the state of Kansas does not take parental abduction lightly. If convicted a parent can face a mandatory 61 months in prison.

DISCLAIMER

This hub is not about anybody in particular. Then again it is about everyone who is or has been afftected by a "family abduction" according to the LEGAL definition of the terms.   If you have issues with this or would like additional information or just someone to talk to, feel free to email me. I'll be glad to discuss things with you and help you contact people if you can't figure it out. Again, this is not personal, just informational. If you need a jumpstart, just let me know.  I'll be more than happy to help.

National Center for Missing Children

Anyone can report missing children to this site. There is an 800 phone number to call. You do NOT have to have a police report but it may help if you do. You can also use this link to report seeing a missing child and should do so any time you think you may have spotted one. It's better to be wrong than it is to be right and not make a report.

The term parental kidnapping describes the wrongful removal or retention of a child by a parent. Because child kidnappings are frequently committed by other family members, the term family abduction more accurately describes such action. Both terms are used interchangeably in this book. Both have civiland criminal meanings.

The link below will take you to a downloadable book which tells you all you need to know to inform the world that your child or children are missing.
